How a staffing agency works

A staffing agency is the legal employer of the temp worker. You — the client — pay an all-in hourly rate and direct the daily work. Below: phases A, B, C, the NBBU CAO and your obligations as inlener.

The three phases (NBBU CAO)

Fase A
First 52 weeks worked

Maximum flexibility. The agency may end the assignment per shift. Pension (StiPP Basic) starts after 26 weeks. No continued payment during sickness in some constructions.

Fase B
Up to 3 years / 6 contracts

Fixed-term contracts with the agency. Continued payment during sickness. StiPP Plus pension. Notice period applies.

Fase C
Permanent contract

Indefinite contract with the agency. Full employee rights: notice period, transition payment, dismissal protection. Often a stepping stone to direct employment.

Roles in the triangle

Three parties: the temp worker, the staffing agency (legal employer) and the client (inlener). The agency pays the wage, withholds tax and social premiums, and arranges pension. The client provides workplace, instructions and safe working conditions.

Your obligations as client

  • Hire only from Waadi-registered agencies (verify via KvK)
  • Apply the inlenersbeloning — same wage as your permanent staff
  • Provide a Risico-Inventarisatie (RI&E) and safe workplace
  • Verify SNA/NEN 4400-1 to limit inlenersaansprakelijkheid
  • Request a G-account payment to shield 25% from liability
  • Sign an inlenersovereenkomst per assignment
